These Terms & Conditions (“Terms”) govern your access to and use of Digital & Dirt (“Digital & Dirt,” “we,” “us,” or “our”) and the learning activities we generate and deliver. By using our website or purchasing from us, you agree to these Terms. If you do not agree, please do not use the service.
1. Who may use Digital & Dirt
Our service is intended for adults. You must be at least 18 years old to create an order or make a purchase, and you confirm that any account and payment information you provide is your own. The learning activities are designed for children, but they are purchased and administered by a parent, guardian, educator, or other responsible adult. We collect information only from the adult making the purchase and do not knowingly collect personal information from children.
2. What we provide
Digital & Dirt is a digital product. We generate and deliver educational activities based on the options you select — such as Path, Track, grade level, progression, size, and theme — either created on demand or served from our library. Activities are delivered electronically for you to view, print, or complete on screen. We do not ship physical goods.
3. Our quality commitment
We stand behind two specific, verifiable promises for every activity you purchase:
It matches its description. The activity you receive will reflect the Path, Track, theme, and size described at the time of purchase.
It meets the grade-level criteria. The activity will be built to the grade level and progression you selected, following our published grade and readability standards.
If an activity does not meet either of these commitments, contact us and we will correct it, replace it, or issue a refund for that purchase. Beyond these two objective standards, learning materials involve subjective preferences, and we handle any other questions or concerns individually as a matter of customer service. 4. License and permitted use
When you purchase an activity, we grant you a non-exclusive, non-transferable license to use it for personal, family, classroom, and other non-commercial educational purposes. You may print and reuse it within your own household, class, co-op, or program. You may not resell, redistribute, sublicense, publicly post, or otherwise share the activities for others to download, and you may not use our materials or outputs to build or train a competing product or service.
5. Intellectual property
Digital & Dirt, including our website, framework, templates, brand, and the systems that generate the activities, is owned by us and protected by applicable law. Except for the license granted in Section 4, no rights are transferred to you. “Digital & Dirt” and our logos may not be used without our written permission.
6. Orders, pricing, and payment
Prices are shown in U.S. dollars and may change over time; the price shown at checkout applies to your order. Payments are processed by our third-party payment provider (Stripe), and by purchasing you authorize the applicable charge. One-time (on-demand) purchases are billed once. Subscriptions renew automatically each month at the then-current price until you cancel, and by subscribing you authorize these recurring charges. You can cancel a subscription at any time; cancellation stops future renewals, and your access continues through the end of the current billing period.
7. Refunds and cancellations
Because activities are digital and delivered immediately, purchases are generally non-refundable once delivered — except where an activity fails to meet our quality commitment in Section 3, in which case we will correct, replace, or refund it. You may cancel a subscription at any time as described above. See our Refund & Cancellation Policy for details.
8. Acceptable use
You agree to use Digital & Dirt lawfully and only as intended. You may not attempt to disrupt, reverse engineer, scrape, or gain unauthorized access to the service, or use it in any way that infringes the rights of others.
9. Privacy
Our Privacy Policy explains what information we collect from the adult purchaser and how we use it. By using the service, you agree to that policy.
10. Disclaimers
Digital & Dirt is provided on an “as is” and “as available” basis. Our activities are educational supplements intended to support learning; they are not a certified or accredited curriculum and are not a substitute for professional, medical, legal, or educational advice. We do not guarantee any particular learning outcome. To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these Terms.
11. Limitation of liability
To the fullest extent permitted by law, Digital & Dirt will not be liable for any indirect, incidental, or consequential damages arising from your use of the service, and our total liability for any claim will not exceed the amount you paid us for the purchase giving rise to the claim.
12. Changes to the service and these Terms
We may update, improve, or discontinue parts of the service, and we may revise these Terms from time to time. When we do, we will update the “Last updated” date above. Your continued use of the service after changes take effect means you accept the revised Terms.
13. Governing law
These Terms are governed by the laws of the United States and the state in which the operator of Digital & Dirt is based, without regard to conflict-of-laws principles.
